1. MANDATORY DEATH PENALTY: FIREARMS, AMMUNITION AND EXPLOSIVES

Section 57 of the ISA prescribes a mandatory death penalty for certain offences to be tried in court,

(1) Any person who without lawful excuse, the onus of proving which shall be on that person, in any security area carries or has in his possession or under his control -

a) any firearm without lawful authority therefor: or

b) any ammunition or explosive without lawful authority therefor,

shall be guilty of an offence and shall, on conviction, be punished with death.

7. (1) Any person who, otherwise than for a lawful purpose—

any scheduled weapon shall be guilty of an offence and shall on conviction be liable to imprisonment for a term not exceeding two years, or to a fine not exceeding two thousand ringgit or both, and in the case of a second or subsequent offence to imprisonment for a term of not less than one year and not more than three years.

(2) In any prosecution for an offence under subsection (1) the onus of proving the existence of a lawful purpose shall be upon the accused.

(3) An offence under subsection (1) shall be deemed to be a seizable and non-bailable offence.

Consorting with persons carrying offensive weapons in public places

8. (1) Any person who consorts with, or is found in the company of, another person who is carrying or has in his possession or under his control any offensive weapon in contravention of section 6, in circumstances which raise a reasonable presumption that he knew that such other person was carrying or had in his possession or under his control any such weapon shall, unless he shall prove that he had reasonable grounds for believing that such other person was carrying or had in his possession or under his control any such weapon for a lawful purpose, be guilty of an offence and shall be liable to the like punishment as that other person with whom he was consorting or in whose company he was found.

(2) An offence against this section shall be deemed to be a seizable and non-bailable offence.

Jelukong Chinese want Krai for polls

KUCHING: The Chinese community in Jelukong, Engkilili, has joined the fray, pledging their support for former SUPP candidate Jonathan Krai Pilo to contest in the next state election.

Despite losing by a mere 426 votes to then SNAP candidate Johnical Rayong in 2006, Krai not only remained popular but has gained more support through his hard work in serving the community.

Since winning the Engkilili seat, Dr Rayong has claimed to be a Barisan Nasional (BN) friendly assemblyman and last October was admitted to the SUPP fold.

However, the recent call of Jelukong’s Chinese community was “due to the people losing confidence in the current incumbent,” as stated in a press statement sent to The Borneo Post yesterday.

“Many people, especially the Chinese communities in Jelukong, are not happy with failed promises and numerous issues not being ironed out by the current Engkilili assemblyman.

“Apart from land issues in Jelukong, proper infrastructure such as road access and drainage and irrigation system are lacking from the Lubok Antu junction area to Meridun,” Krai was quoted as saying in his speech during a Chap Goh Mei celebration dinner organised by Jelukong To Pak Kong.

He recalled that many promises were made to help the people, such as the announcement of the RM29 million rural electricity supplies (RES) and road infrastructure projects to connect rural areas, but to date they had not materialised.

Krai also claimed that the Engkilili assemblyman told the people of Semanju, Lidong and Batang Ai about the proposed projects but when nothing seemed to be happening, Dr Rayong resorted to blaming certain agencies and even the state government for not implementing the projects.

Additionally, Krai said he received reports from numerous longhouse chiefs in the constituency, claiming that many of the longhouse development and safety committees (JKKK) had yet to receive minor rural project (MRP) funds that had been announced in the past including those for schools and associations.

On the voters’ call for SUPP to nominate him to contest in the next state election, Krai said he was prepared and confident.

Kapitan Bong Jin Choon who was also present at the dinner said Krai remained a strong and influential SUPP representative in Engkilili.

He believed the voter swing in favour of Krai was big despite Rayong’s claim that he could command a landslide victory for the BN in the next state election.

Bong said: “The Chinese community in Jelukong, Engkilili wants the party (SUPP) to give Jonathan Krai another shot in the coming state election.

“He is close to all races and despite losing in the last election, he continues to work hard on the ground and is politically more matured now. He is undoubtedly loyal to SUPP and BN.”

Bong said Krai was considered a local by many, considering that his late mother was from Lio, Engkilili.
This clearly contradicted Dr Rayong’s 2006 election campaign touching on the ‘local boy’ angle.

The Kapitan expressed his amazement on Dr Rayong’s recent admission to SUPP’s fold, stating that during the last state election, Dr Rayong had accused SUPP of being a (political) party for the Chinese only and that his battle cry back then was “Throw SUPP out from Engkilili”.

“Most of the community has lost their respect and confidence for the incumbent.

“Added to his personal problems and scandals which surfaced online, he certainly has lost his credibility,” Krai commented.

During the dinner, Krai presented a personal donation to the Jelukong To Pak Kong, represented by its chairman Bong Kee Soon.

Ibi Uding We Know What You Did Last Election In Year 2006

Revisited Ibi Uding Campaign Trail in 

Year 2006 State Election 

Before the 12th General Election (GE12) Perak was a Barisan Nasional (BN) stronghold. But in GE12, Pakatan Rakyat made history in Perak by defeating Barisan Nasional by 31 to 28 Seats.But the Pakatan Rakyat victory was short-lived when the 3 lawmakers from PR deserted the alliance and declared their supports for Barisan Nasional. The three lawmakers were Hee Yit Foong the Deputy Speaker from DAP, and two senior state Executive Council member from PKR Jamaluddin Mohd. Radzi and Osman Jailu.

According to the grapevine all the three lawmakers who deserted PR were offered with substantial amount of monies, award with datukship and for Jamaluddin and Osman Jailu their corruption cases were dropped.

Pakatan Rakyat in Sarawak especially Parti Keadilan Rakyat (PKR) should learn from Perak fiasco by paying extra attention in selecting its candidates for the coming state election. Personally I would like to advise the party not to select the candidate to represent the party in the coming state or parliamentary elections from these two categories. Firstly, the members  who join the party because they were unwanted by Barisan Nasional, and secondly, the members who join the party because they want to stand in the election.
But today I want to write about a party member just to be selected as a candidate, and later after winning the election, join BN with big offer!  

Becomes Candidate For Business 

Ever heard about candidates who withdrew their candidacy in the  last minutes, or who announced their supports to the opposing candidate immediately after the nomination closed?. There are many possibilities of such actions. One of the possible cause is the candidate is offered with substantial amount of monies.

One of the politician who had betrayed her voters was Ibi Uding, the current Woman Chief of  Parti Keadilan Rakyat (PKR) Sarawak . Ibi who stood in N25-Balai Ringin under Sarawak National Party (SNAP) ticket against Snowdan Lawan (BN) and Saudara Cubbold John (Ind) during the state election in year 2006, according to her campaign partners had received the offer from YB Snowdan Lawan and his father, ex-YB Donald Lawan. Even though she did not withdraw her candidacy officially, but after the meeting , she immediately discontinued her campaign. .

Relating what happened on that day, one of Ibi Uding campaign team member TR Bidi (picture above) from Empili  said :

" On Sunday, 14th May *2006 at about 4.00PM, I saw Pelie ak Jumbu and Ibi Uding  meeting with YB Snowdan lawan and Donal Lawan at PRS Operation Room at Simpang Punda." 

"Immediately after the meeting, Ibi Uding stopped her campaign", said TR Bidi.

Another witness who saw the meeting was  Beisy ak Ringan from Bayur.

As the meeting were between the four, there was no information on the amount of monies received by Ibi. But the reliable source to Bukittunggal said that Pelie ak Jumbu were given RM10K by Ibi.

In the election Snowdan Lawan secured 3,075 votes, Ibi Uding  1,559 votes and Saudara Cubbold  742 votes. Should Ibi did not accept Snowdan offer, and proceed with her campaign, the result of the election could be different or won by her.

If PKR want to win N25-Balai Ringin with the candidate reliable to PKR struggle, the party should not nominate Ibi as the party's candidate. Based on what happened in 2006 election, if she is chosen as a candidate, the tendency is there that she will betray the party by repeating what she had done in year 2006. For Ibi , election is just like doing business. She will accept the monies, if not during the election by withdrawing her candidacy, she will follow the actions of the three pakatan law makers in Perak.

According to reliable source both TR Bidi and Beisy were willing to give statement to PKR Disciplinary Committee if  request by the party.

Conclusion/Recommendation

As reported by the two witnesses, TR Bidi from Empili and Beisi ak Ringan from Bayur, Ibi Uding had accpted monies from YB Snowdan Lawan and Donald Lawan in the state election held in year 2006. Even though no amount of money was revealed but  the grapevine said Pelie ak Jumbu was given RM10K by Ibi.

The party should not gamble the future of  the voters in N-25 Balai Ringin by selecting Ibi Uding as their candidate in the coming state election.

The party should find a reliable and good  party members as a candidate in the coming state election for N25-Balai Ringin.

Politicians call for action against blog and rogue station

KUCHING: Now that the brains behind Sarawak Report and Radio Free Sarawak have been exposed, politicians from both sides of the divide are calling for action to be taken.
Sarawak United People’s Party youth chief Sii Hua Tong asked the authorities to find out if the blog and radio station had committed any offence.

“There is no need to create something to threaten the nation. No one in our country, whether in Barisan Nasional or the Opposition, will want to see our country in chaos. Whether those responsible are overseas or not, when they interfere in our nation’s interest and threaten national security, it is a serious matter.
“If what they allege is true, they must have evidence,” he told Star Sarawak yesterday.

Parti Pesaka Bumiputera Bersatu deputy president Datuk Amar Abang Johari Tun Openg said that he had been monitoring what was aired and opined that the contents were just rhetoric.

“Well, it is close to election and so you can expect a lot of things to pop up. I don’t like rhetoric,” he said.
Clare Rewcastle Brown, the sister-in-law of former British Prime Minister Gordon Brown, and Peter John Jaban, an Iban activist known as Papa Orang Utan to his listeners, went public on Wednesday saying they were responsible for the blog and radio station in a British tabloid report.

Sarawak Report and Radio Free Sarawak have been very critical of Chief Minister Tan Sri Abdul Taib Mahmud.

Sarawak Barisan Nasional Backbenchers Club chairman Abdul Karim Rahman Hamzah had said that what the duo had done was “malicious and dangerous” and that they had campaigned not only against Taib but also the nation.

Opposition leaders yesterday appealed to the authorities to launch an investigation, particularly on the claims as alleged in Sarawak Report.

“The most important thing is whether the claims are true or not. If their claims have no grounds, the authorities should take action against them. If there are, then the Malaysian Anti Corruption Commission should take action,” Sarawak PKR chief Baru Bian said.

“Whether they are foreigners or locals, what is important is the truth. A responsible government should take action to clarify the allegations.”

Sarawak DAP secretary Chong Chieng Jen, on the other hand, said that the Chief Minister should make a public statement in response to the allegations.

“He should at least clear his name. So far he has been keeping mum, which is unacceptable,” Chong said.
Both Sarawak DAP and PKR said they were not linked to the blog and radio station, but were open for interviews if they received invitations from them.

Ex-British PM’s relative behind Radio Free Sarawak

Radio Free Sarawak, which has gained extensive ground in rural Sarawak with its stories about Chief Minister Taib Mahmud's plundering ways, has finally revealed its owners.

KUALA LUMPUR: Until a few hours ago, the identities of those behind Radio Free Sarawak (RFS) were a closely-guarded secret.

Now a British tabloid has unmasked the duo as Clare Rewcastle Brown, the sister-in-law of former British prime minister Gordon Brown, and Peter John Jaban, the grandson of a Dayak headhunter.

London-based RFS was launched last November on the promise of bringing alternative news to the people of Sarawak.

Controversial blogger, Raja Petra Kamarudin, came on board as a regular contributor a month later.
According to news tabloid, Evening Standard, Rewcastle Brown, 51, was born in Sarawak to British parents and lived in the region until she was eight.

She returned 38 years later and was shocked by the extent of the deforestation taking place in the rainforest.
It was while covering a 2008 by-election there that she met Jaban, 46, and proposed that he become the voice of RFS.

In her interview with the tabloid, Rewcastle Brown, who is also the author of the blog Sarawak Report said: “I use my blog and broadcasts to expose the outrageous deforestation which has seen 95% of Sarawak’s rainforest cut down and replaced by logging and palm oil plantations which have enriched Taib and his family.”

“What’s more, my investigations indicate some of the Taib family money is right here in London and includes a lucrative property portfolio in the heart of our capital. My work is about giving the 2.5 million oppressed people of Sarawak a choice.”

She said Taib and his family also had property empires in Canada, the US and the UK and that Taib derived his funds by “selling off rainforests” and channelling some of the money “through the British Virgin Islands”.

Death threats
Rewcastle Brown further explained that her decision to go public followed death threats on the Sarawak Report website and the mysterious death of her chief whistleblower and Taib’s former US aide, Ross Boyert, last December.

Jaban, who goes by the moniker Papa Orang Utan, meanwhile expressed pain at having to leave his family behind but asserted that he was prepared to “die for this cause”.
“In the days of my grandfather, you had to bring a decent clutch of heads as a sign of your masculinity when you got married…

“Today things have changed but you still have to be a man,” he was quoted as saying.
While Rewcastle Brown acknowledged the high likelihood of Taib intimidating the voters during the next Sarawak election, she also believed that RFS had had a huge effect on Sarawakians and that there was a strong movement towards change.

Her words were confirmed by prominent Dayak-Iban social activist and blogger John Brian Anthony.
“A change is definitely taking place and it’s very real,” he told FMT.

“RFS has brought about a sharp awareness among the people here. These days they are talking about topics that they would not normally discuss like abuse of power, Taib’s wealth and NCR land.

“I’m taken aback at how much public perception has changed recently in both the urban and rural areas. And those in the urban areas are now looking to those in the rural areas to supply them with information on what is really going on in the Sarawak interiors.”

Angry government
John, who is behind the Dayakbaru.com blogsite, added that those who were able to receive the RFS frequency were loyal listeners.

A group of activists distributed CDs of the shows podcasts to those who weren’t able to tune in.
“The Dayaks especially are very audio-inclined people what with their extensive oral history.
“The fact that Peter (Jaban) speaks fluent Iban is also a big plus point.

“So now we have Sarawak natives coming forward to share their personal stories with RFS,” he said.
When asked about the Taib administration’s reaction, John laughed: “They are very angry of course.

“Just a few days back two activists were arrested for distributing the CDs but they were released without charge because the content was issue-based and not anti-government.”
